What is the Regulation on Pesticides Administration? This Regulation is promulgated by the State Council of P.R. China to supervise and control manufacturing, marketing and use of pesticides/agrochemicals in China. It entered into force on May 8, 1997, and was revised on 29th November 2001 according to the decision of China State Council. Two subordinate regulations were issued by China Ministry of Agriculture to provide guidance on implementation of this Regulation.     What should I do under the China Pesticides Regulation? The production, management and application of agricultural chemicals within the territory of the People’s Republic of China shall observe these Regulations. Regulation on industrial Chemical in Korea

Toxic Chemicals Control Act Toxic Chemicals Control Act ((Hereafter referred to as TCCA) was enforced on Feb.2, 1991. The latest amended TCCA came into force on Jan.1, 2006. TCCA is focus on controls of the new chemical substances, the high concerned chemical substances and also distribution and discharge of Chemicals, which is Pollutant Release and Transfer Register (PRTR). The new chemical substances are those which are not covered by the Korea Existing Chemical Inventory (KECI). Currently, KECI contains 41,000 chemical substances. New chemical substance shall be evaluated and notified before manufacture and/or import. TAIWAN Existing Chemical Nomination & New Chemical Notification

Existing Chemical Substance Nomination (ECN) and New Chemical Notification (NCN) program is commencing in Taiwan under the Council of Labor Affairs (CLA) assisted by the Safety and Health Technology Center (SAHTECH). The Nomination process for listing substances on the inventory has closed year-end 2010. Both domestic and non-domestic manufacturers/importers can nominate substances via on-line tools. Substances not nominated or otherwise exempted, will be subject to New Chemical Notification procedures to be implemented June 2011.

“Act on the Evaluation of Chemical Substances and Regulation of Their Manufacture etc” is well known as “Chemical Substances Control Law (CSCL)” which has imposed strict pre-marketing evaluation of chemical substances that were introduced on the market from 1973 onward (i.e., after the enactment of the Law).CSCL was amended in 1986, 2003, 2009 respectively after its implementation. The conception of GHS was adopted by many countries in the subsequent years, including China. China REACh Came into force on Oct 15 2010

China’s existing Regulation for chemical substances refers to the Measures on the Environmental Management of New Chemical Substances, which was issued by the State Environmental Protection Administration (SEPA) of the Ministry of Environmental Protection (MEP) on September 12, 2003 and became effective on October 15, 2003. The revised version of Measures on the Environmental Management of New Chemical Substances has been dubbed “China REACH”, since it draws on many elements of REACH, particularly those concerning risk assessment, risk management and data submission. China REACH – Version 2010, adopted on 30 December 2009 and published in January 2010, will come into effect from 15 October 2010. After that, the old Regulation issued on 12 September 2003 will be abolished. It will affect all production activities, import and export of the new chemicals in China. Data Requirements under China REACH and EU REACH: What are the Similarities and what are the Differences?

It could easily forecast that the chemical management systems of more and more countries are/will be changed with forcing by the globalised nature of the chemicals industry to introduce similar controls of EU REACH regulation. In order to adapt new situation of environmental protection, china’s Ministry of Environmental Protection (MEP) promulgate “Measures on Environmental Management of New Chemical Substances” (No. 7, also called China REACH) instead of the older version in 2009. Now, it already came into force since 15th October 2010.   All companies are obliged to notify new chemical substances, which are not listed on the IECSC, to the Chemical Registration Centre (CRC) before they are exported to China. In common with the submission of EU REACH registration dossiers, datasets are also required to support China REACH notification applications.
