CFSA Consults on New Food Additives Derived from Recombinant Biotech

Takehome: China is now soliciting opinions on 7 new food additives, including 6 food additives derived from recombinant biotechnology (bacterial horizontal gene transfer). New bacterial expression vector sources and hosts are specified. One food additive is proposed to have its usage expanded. On April 2, 2019, CFSA released notices and consulted on the use of 7 new food additives. They are glucose isomerase, lipase, alpha-amylase, monascus yellow pigment, β-galactosidase, xylanase and α-L-Arabinofuranosidase. Read More

Takehome: On April 1st, 2019, China approved the registration of 24 infant formulae, including a goat milk infant formula product line. On April 1st, 2019, SAMR updated the registration information of 24 infant formula products. China SAMR to Append Health Food Positive List with 5 New Functional Ingredients

Takehome: China will take the unprecedented step of appending its health food raw materials directory (essentially a positive list of ingredients that are eligible for filing which previously only included vitamins and minerals) with several new ingredients including coenzyme Q10, melatonin, fish oil, reishi shell-broken spore powder and spirulina. On Mar. 28, 2019, China SAMR opened 5 health food ingredients to public feedback. The ingredients are proposed to be added to the health food raw materials directory. The deadline for consultation is Apr. 30. The announcement lists the new ingredients proposed to be applied in health food and stipulates their usage as well as the technical requirements. China Consults on Adjustment and Cancellation of Health Food Functional Claims

Takehome: China is currently consulting on proposed amendments to the permitted terminology, scope of claims and appropriateness of the 27 functional claims currently used for health foods in China. On March 28, 2019, State Administration for Market Regulation (SAMR) began consulting on adjustment to health food functions, specifically an adjustment to the permitted terminology used in 18 of the current 27 acceptable functional claims, cancellation of 3 out of the 27 functional claims, and further investigation on the appropriateness of 6 other claims which skirt the boundaries of medicinal claims. E-commerce Platforms Initiate Preemptive Self-Regulation of Health Foods

Takehome: Both Tmall and JD are regulating the scope of health food and health related food products sold on their platforms. Both companies have stopped several specific types of health foods from being sold on their platform. China’s two ecommerce giants Tmall[1] and JD.com[2] have both taken measures to curtail the retail of certain types of health foods. JD has halted expansion in the scope of health foods sold on its own shop, citing that it has no brand expansion plan for now. Tmall halted expansion in retail of unregistered/unfiled healthcare products whose main ingredients are L-carnitine, papaya and maca. The reasons have not been specified, but we assume much of this was triggered by the 100-day crackdown[3] on illegal practice involving health related products and redirection of responsibility away from the government and towards enterprises & platforms.   Read More

Chinese Infant Formula Tests Positive for Pathogenic Bacteria

Takehome: 2 batches of registered Chinese infant formula milk powder failed sampling inspection conducted by SAMR. One batch tested positive for enterobacter sakazakii. On Mar. 7, 2019, China SAMR announced the domestic sampling inspection result of 2936 batches of food products. 2 batches of infant formula food failed the inspection. A batch of “Meijia” infant formula milk powder (stage 1) manufactured by Heilongjiang Nongken Yingbohuawei Dairy Co.,Ltd. tested positive for enterobacter sakazakii.   Read More
