China NIFDC Consults on Updates to Prohibited Cosmetic Ingredients and Test Methods

China is moving towards updating the Inventory of Prohibited Ingredients for Cosmetics and adopting more toxicological test methods for cosmetic ingredients, as well as animal testing alternatives. On June 12, 2023, China\’s National Institutes for Food and Drug Control (NIFDC) initiated a public consultation on proposed updates to the Inventory of Prohibited Ingredients for Cosmetics, along with the introduction of test methods for cosmetic ingredients. Interested parties are invited to provide their feedback and suggestions until July 15, 2023, by submitting the \”Opinion Feedback Form\” via email to hzpbwh@nifdc.org.cn. Five new prohibited ingredients The proposed updates to the Inventory of Prohibited Ingredients for Cosmetics is the addition of five prohibited prostaglandin analogs. China Seeks Feedback on Guidelines for Submitting Cosmetic Ingredient Safety Information via Official Platform

Guidelines for Submitting Information through the Cosmetic Ingredient Safety Information Submission Platform clarifies the application scope of the platform, the submission principles, necessary documents, and the obligations of cosmetics registrants and notifiers. Background According to the Provisions for Management of Cosmetic Registration and Notification Dossiers (the Provisions), when applying for cosmetic registration and notification, it is required to submit ingredient safety information; On March 27, 2023, National Medical Products Administration (NMPA) announced to extend the transition period of the cosmetic ingredient safety information submission policies to January 1, 2024. Consisting of 11 parts, the draft specifies cosmetic registrants’ and notifiers’ responsibility for ingredient quality and safety, refines the requirements for filling in and submitting ingredient safety information, as well as gives instructions on handling changes to ingredient safety information. ASEAN Updates Cosmetic Ingredient Annexes for ACD: 42 New Ingredients Added and 10 Revised

The main amendments include: 1) adding 42 prohibited ingredients, and revising the requirements for 1 prohibited ingredient; 2) revising the requirements for 4 restricted ingredients; 3) revising the requirements for 1 permitted colorant; 4) revising the requirements for 3 permitted preservatives; 5) revising the requirements for 1 permitted UV-filter. In January 2023, ASEAN introduced the latest amendments to the ingredient annexes to ASEAN Cosmetic Directive (ACD). These amendments were approved in the 36th ASEAN Cosmetic Scientific Body (ACSB) meeting, and will officially take effect on November 21, 2024. China Implements Strict Cosmetic Sampling and Testing Regulations Under CSAR Subsidiary

In September 2020 and June 2022, China NMPA issued two drafts of Measures for the Management of Cosmetic Sampling Testing (Measures). Finally, on January 12, 2023, NMPA released the finalized Measures. On Mar. 1, 2023, China National Medical Products Administration (NMPA) implemented Measures for the Management of Cosmetic Sampling Testing. The Measures is divided into 8 chapters and 61 articles, providing detailed requirements on the formulation of sampling testing work plan, sampling, testing and result submission, objection and re-testing, verification and disposal of unqualified products, as well as information disclosure. The new rule highlights that for ingredients without an ingredient submission code, cosmetics registrants and notifiers can now fill in and submit the ingredient safety information documents by themselves. The transition period of the cosmetic ingredient safety information submission policies has been extended to January 1, 2024.
