SFDA Simplifies Modification Application of Cosmetic Administrative Licensing

SFDA consults on a draft notice of further simplifying modification of companies’ names or addresses on the condition that the production site does not been changed.

According to the notice, cosmetic manufacturers that already obtain the hygiene license or record keeping certificate from SFDA, are allowed to apply for one-time modification of names, addresses, responsible agents in China together with product information that is under processing. Documents that have been submitted before need not submitting repeatedly.

Special Check on Domestic Non-Special Use Cosmetics

Recently, Fujian Food and Drug Administration carried out a special check on domestic non-special use cosmetics. Enterprises involved in the production of whitening, acne-removal, anti-wrinkle cosmetics are under stringent supervision. The focus of this inspection is to investigate whether enterprises have applied for record keeping for domestic non-special cosmetics, hygiene and quality of cosmetic products and factory, and the extension and verification of hygiene license for production enterprises of cosmetics. Through this news, we can get the indication that the government exercises more strict control over domestic non-special cosmetics and their production enterprises. According to Article 19 in Detailed Rules for the Implementation of the Regulation concerning the Hygiene Supervision over Cosmetics, enterprises producing domestic non-special use cosmetics must apply for record-keeping to Food and Drug Administration (FDA) at provincial level within two months after products are placed on the market. SFDA Issues the Official Guidance for the Identification of Fast Testing Methods for Health Food and cosmetics

With a view to enhance the ability of testing health food and cosmetics, SFDA formulated the Identification of Fast Testing Methods for Health Food and cosmetics, according to Food Safety Law and Regulations Concerning Hygiene Supervision over Cosmetics on June 29, 2012. On May 24, 2012, SFDA consulted on the draft of this Guidance. There is no difference between the draft and the final version through comparison. Attention on the Labelling of China Cosmetics

Recently, Gansu Bureau of Quality and Technical Supervision has conducted a spot inspection on 40 batches of children cosmetics (mainly used by infants under 6 years old), among which the labelling of 3 batches are not qualified. Some production enterprises of children cosmetics failed to print all ingredients on the label.

According to Instruction for Use of Consumer Products—General Labelling for Cosmetics (GB 5296.3-2008), all ingredients shall be completely and authentically printed on the visible panels of cosmetics sales packagings to facilitate consumers to identify ingredients that may cause skin allergy and harm easily to some children and shall be listed in descending order of “quantity”. The names of ingredients should be in line with standard Chinese names translated according to International Nomenclature Cosmetic Ingredient (INCI). If a name is not covered by INCI, cosmetics enterprises can use the corresponding name in Chinese Pharmacopoeia, its chemical or botanical name.

Breaking the ice: assessing risk in Chinese cosmetics

Following the publication last year of guidelines for the risk assessment of impurities in cosmetic ingredients, China is preparing similar guidelines for assessing the ingredient themselves, explains Martin Hu of REACH24H Consulting Group. In keeping with the strategy of the Ministry of Health (MoH), China’s State Food and Drug Administration (SFDA) mainly focused on the supervision of the quality and safety of finished cosmetic products. This was until several cosmetic safety incidents occurred including the discovery of chromium and neodymium in products in 2006, traces of acrylamide in facial creams in 2007, illegal black hair dyes and 1,4-dioxane in baby products in 2009. The SFDA gradually realised that merely supervising the safety of the cosmetics by means of “terminal control” and neglecting the quality of raw materials was insufficient and risky.
