China to Tighten Supervision over the Health Food Logo

On March 21, 2022, the State Administration for Market Regulation (SAMR) issued a drafted notice regarding the supervision over the health food logo. Comments can be sent to bjspjgc@163.com till April 21, 2022.

Here are key points revealed by the proposed notice.

1. Definition of the health food logo

The logo of health food is the exclusive mark for health food registered or filed in China, which shall be marked on the minimum sales package of health food products.

2. Size and location of the health food logo

The logo of health food shall be the pattern specified by SAMR, and shall be marked on the top left of the main display panel of the packaging in equal proportion, and shall be clear and easy to identify. If the surface area of the main display panel is greater than 100cm2, the width of the widest part of the health food logo shall not be less than 2cm. Otherwise, the width of the widest part of the health food logo shall not be less than 1cm.

3. Use of the health food logo

Health food manufacturers and business operators can use the health food logo in production and business operation sites, as well as health food areas and counters. The health food logo can be changed in proportion according to the actual needs, but it shall not be deformed or discolored. The specifications of the logo, including the overall proportion, color and font are also detailed in the notice. Besides, the health food logo shall not be used for non-health food.

4. Supervision over the health food logo

The holder of the approved filing or registration certificate of health food, and the manufacturer and business operator of health food shall ensure that the health food product on the market is marked with the health food logo as required. Competent authorities at all levels shall strengthen the supervision and administration of the health food logo.

Once the proposed notice gets approved, the Provisions in the notice will be effective from December 1, 2022, and health food products produced before the implementation date can still be sold until expiration.
