China Legislates on Dust Explosion Protection for Industry and Trade Enterprises
On August 2nd, 2021, the China Ministry of Emergency Management (MEM) issued its Order No.6 [1] to publish the Safety Regulations on Dust Explosion Protection for Industry and Trade Enterprises. The Regulations are formulated in accordance with the newly issued Work Safety Law and will enter into effect on September 1st, 2021, simultaneously with the Law.
The Regulations consist of five chapters as follows:
- Chapter 1 General Provisions, which specifies the background, terms and definitions, main responsibilities, and authorities;
- Chapter 2 Guarantee of Safe Production, which specifies the person responsible for dust explosion protection, the safety management system, risk factors identification, explosion-proof measures, etc.
- Chapter 3 Supervision and Inspection, which specifies the responsibilities of authorities on inspections, key inspection items, testing and examination, etc.
- Chapter 4 Legal Responsibilities, which specifies the violation circumstances and corresponding penalties;
- Chapter 5 Supplementary Provisions, which specifies that the implementation date of the Regulations.
On June 10, 2021, a revision to the Work Safety Law of the People’s Republic of China was adopted at a meeting of China’s top legislative body. The revision has improved the responsibility system for production safety and involves precautions for and solutions to new problems and risks.
