South Korea Initiates MSDS Self-check Campaign, Followed by Official Inspection
On April 8, 2022, South Korea’s Ministry of Employment and Labor announced to initiate a nationalwide supervision campaign on MSDS. Korean manufacturers and importers are required to review internal management on MSDS and fill in the self-check list from April 11, 2022, to May 31, 2022. The Basin/Regional Departments of Employment and Labor conduct spot checks from July 2022 on the compliance of units and rectify issues uncovered.
The self-checklist mainly focuses on issues regarding
- Preparation, online submission and delivery of MSDS;
- Elements on MSDS (including usage, classification, name and content of components, and regulatory information) and its update;
- Publicity of MSDS, employee training, etc.
* The self-checklist shall be signed by the legal representative and kept for inspection.
According to the Occupational Safety and Health Act (OSHA), MSDS submission and CBI non-disclosure approval through the IT system is mandatory. For chemicals circulated in Korea with MSDS prepared before January 16, 2021, grace periods (up to 5 years) are given based on the manufacture/import volume of chemicals (read more).
According to the authority, manufacturers and importers of hazardous chemicals>1,000 y/t will be prioritized for inspection since the grace period for MSDS submission has ended. For those still enjoy the grace period, it is recommended to submit MSDS as well.
