On August 8, 2022, Shanghai Municipal Transport Commission, jointly with the Shanghai Emergency Management Bureau and Shanghai Municipal Public Security Bureau, unveiled the Notification on Further Strengthening Management for Road Transport and Storage of Dangerous Goods (Hazardous Chemicals) in Shanghai (hereinafter referred to as the Notification), which has come into force from August 15, 2022.

Shanghai, as a large port in China and an important manufacturing base for the chemical industry, is implementing the digitalization of hazardous chemicals management and supervision to ensure public safety and enterprise compliance. A digital information and supervision platform named Dangerous Goods (Hazardous Chemicals) Road Transportation Whole Process Management System (hereinafter referred to as the System) has already been launched, which enables authorities to easily access updated information and dynamically supervise and individualize responses to practice situations. Given these circumstances, the supervisory authorities issued the Notification to reaffirm legal responsibilities for stakeholders (shipper, carrier, consignee, etc.) and stress relevant provisions based on the following laws and regulations:

• Work Safety Law of People’s Republic of China
• Regulation on the Control over Safety of Hazardous Chemicals
• Measures for the Safety Administration of Road Transport of Dangerous Goods
• Provisions on the Road Transport of Dangerous Goods
• Measures for the Dynamic Supervision and Administration of Road Transport Vehicles
• Measures for Safety Management of Hazardous Chemicals in Shanghai

In line with these laws and regulations, the Notification emphasizes that stakeholders should fulfill the obligations in regard to the inspections for information on the manufacture, storage, use, operation and transportation qualification of dangerous goods (hazardous chemicals) and related transportation information. As per the Notification, the spot inspections of road transport vehicles carrying dangerous goods (hazardous chemicals), when they enter or leave the designated road intersections within Shanghai, are now replaced by inspections of the corresponding information submitted to the System. Before the dangerous goods (hazardous chemicals) are loaded on the transport vehicles, shippers should verify the five must-check issues (i.e., transport vehicles, personnel, tanks, waybills and other information). The transport vehicles that do not have inspection information in the system or have not passed the inspection are not allowed to enter the operation area to load dangerous goods (hazardous chemicals).

New requirements are stipulated in the Notification as well. For example, carriers outside Shanghai city, if have transported dangerous goods within the administrative area of Shanghai for more than 3 months, shall apply for record notification. Notably, the authorities will strengthen the law enforcement and any violations of the Notification will be penalized.
